Right to cancel

  • You have the right to cancel your order within 14 working days without any reason. This is the 14 day “cooling off period” in accordance with distance selling regulations.
  • This cancellation period will expire after 14 working days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires physical possession of the sunglasses.
  • Goods returned must be unused, in their original condition with security tag in-tact to be eligible for a refund.
  • To exercise your right to cancel, you must inform us of your decision to cancel your order by a clear statement. (e.g. Returns Form or by email to sales@nushades.co.uk)
  • To meet the cancellation deadline, it is sufficient for you to send your communication concerning your right to cancel before the cancellation period has expired.

Further to these regulations we offer the right to return unused goods, in their original condition, within 30 days from the receipt of the goods.

Effects of cancellation

If you choose to cancel your order within this 14 day period, we will reimburse to you all payments received from you (including initial standard delivery charge) to your original method of payment. Please note that once processed, refunds may take up to 5 working days to appear in your account. As above, we also offer the right to return goods within 30 days, however the initial delivery charge will only be refunded if the order is cancelled within the 14 day cooling off period.

We will make the reimbursement

  • Within 14 working days after the day we receive back from you any goods supplied, or
  • (if earlier) 14 working days after the day you provide evidence that you have returned the goods, or
  • If there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
  • If the sunglasses return to us in the same unworn condition as were sent to you.
  • If the security tag remains in-tact around the bridge of the sunglasses and they are in their original undamaged case and/or box.

We will make the reimbursement using the same means of payment as you used for the initial transaction.

Exchanges and replacements

All exchanges or replacements are subject to stock availability. There may be a waiting period for the sunglasses to be re-ordered.

Customer Returns

Complete the Returns Form explaining the reasons for return, re-package the goods and include the returns form in the box. Unless faulty, return delivery costs are at the consumers expense. Please send your order back to us using whatever postage provider you choose, however, we recommend sending the sunglasses back to us using a recorded delivery service due to the high value of goods. The returned parcel remains your responsibility until it reaches us. Once we receive your return and check the goods, we will process your refund/ exchange including initial standard delivery cost.

Faulty Product or damaged

Please note that any products returned to us which you claim to be defective will be checked and verified by our team. Any returned products that are not found to be defective will be returned to you and we may charge you for the returned transport costs via your original payment method or hold the product until full payment has been received by us for the return transport costs.

If you notify a problem to us under this condition, our only obligation will be, at your option:

  • To make good any shortage or non-delivery;
  • To replace or repair any goods that are damaged or defective; or
  • To refund to you the amount paid by you for the goods in question via your original method of payment.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as above.

Limitation of liability

NuShades will not be liable to you for any loss or damage in circumstances where:

  • There is no breach of a legal duty owed to you by the supplier or by its employees or agents;
  • Such loss or damage is not a reasonably foreseeable result of any such breach;
  • Any increase in loss or damage resulting from breach by you of any item of this contract.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a customer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
